American congressmen reintroduced for consideration the “Law of the American Sleep and Promise” that seeks to give a path to citizens to Daca beneficiaries, TPS or deferred forced exit. This project has been presented to Congress on another three occasions.
The “Dream and the American promise” will return to the United States Congress with the support of a bipartisan group of pro -immigrant legislators and organizations, as Wednesday announced Democratic congresswoman Sylvia García.
The project seeks to offer a path to US citizenship for deferred action beneficiaries for children's arrivals (DACA), temporal protection status (TPS) and deferred forced output (DED).
“We already have more than 200 sponsors, so I am not here alone … we are going to fight hard to ensure that I get to the president and we are going to tell him that if he wants a solution, we have it and we have a plan … It's time to act on behalf of all Americans and protect these people who have been here all their lives,” Garcia said in a press conference.
In an interview in December 2024, the then elected president of the United States, Donald Trump, said he had to “do something about the dreamers because they are people who were brought very young and many are now medium -sized, do not even speak the language of their countries.”
Trump said he would seek to “work with the Democrats in a plan” but, according to the president, “they have made it very difficult.”
“Biden could have done it but did not,” he added.
On Wednesday, during the announcement, Texas Democratic congressman also joined a dozen representatives, including Andriano Espaillat and Nydia Velázquez in New York.
“The dreamers and the beneficiaries of the TPS have done everything right. The rules continue, they work hard. They have made sacrifices. And, by the way, TPS beneficiaries came here because the United States government invited them to come. From El Salvador to Haiti, to countries in Africa, Venezuela … They are here, working hard and complying with the rules, ”said Velázquez.
The “dreamers” are young people who arrived in the US without a immigration status during their childhood and through DACA, they have a temporary relief of the deportation and authorization of work.
How would this law work?
The bill is divided into two parts. The first section called “American Dream” stipulates that a permanent conditional residence must be provided for 10 years to those who have entered the US being a minor and have a status of Daca, TPS or DED.
The requirements include that the person is physically present continuously in the country, which approves a background verification and has completed certain educational programs.
Having a “permanent conditional residence” means that the US government would have the power to remove the status if it determines that the person breaches the conditions required to request it.
The second part, called “American promise” seeks to extend these protections to other people who arrived in the US being of legal age and are sheltered or eligible for TPS and DED, and have been in the country at least three years in a row.
In the US, immigrants who have permanent residence for five years can request US citizenship.
Alexis Toro Juárez, a Daca beneficiary said during the press conference that this law would provide the “stability” that he needs to continue his university studies.
“I am also undocumented and I am not afraid, although my family and I moved to the US when I was a child; It was until my last year of high school that I really began to face the realities of being undocumented … when I heard for the first time that the American sleep and promise law would be presented again, I felt a sense of hope again, ”said Toro Juárez.
This bill had been presented in 2019, 2021 and 2023. The first two occasions managed to pass the House of Representatives, but failed to be considered in the Senate. The last one, in 2023, was referred to the Justice and Education Commissions, without going from there.
On the most recent occasion he had 207 co -crossroaders. Until September 2024 there were about 538,000 active beneficiaries of DACA, most Mexico, El Salvador and Guatemala. The more than 863,000 people would have TPS.
In 2017, during its first term, the Trump administration announced the end of DACA, which unleashed a series of demands that paused the expiration of these benefits. In January 2025, a federal judge determined that Daca was illegal, however, allowed requests to renew benefits.
Currently, the US government is not processing new requests from DACA.
